Chinese Online Mediation and Litigation Rules Extend to Banking and Insurance Sector
China’s China Banking and Insurance Regulatory Commission (CBIRC) and the Supreme People’s Court have launched an online litigation and docking system to handle a growing number of banking and insurance industry disputes.
The platform allows participants to mediate disputes online by video and involves the issuance of judgements online and subsequent mediation statements.
The new process will allow courts at all levels to lodge banking and insurance-related disputes for mediation in accordance with the relevant regulations, with industry mediation organisations able to allocate cases online, track mediation progress, and collect statistics on mediation data.
The shift online complements broader efforts to move dispute resolution online. In August the Rules of Online Litigation of the People’s Court of China came into effect, aiming to address dispute resolution across a range of areas, notably between consumers.
